So I just received a used Gretsch RB 16" floor tom and the pictures implied it came with legs. The drum arrived and no legs. I write to the seller, pointing out that the legs were shown in the photos. Here is his response:
First off the legs in that pic were for another drum - big mistake - apologies!
Second, the legs are crap - absolute sheeet - and you wouldn't use them anyway - rusted big time!
Third, the legs are all odd - again why I DID NOT mention them in the auction. No where did I mention legs. The legs were on top of a drum that was not in the auction. I'm selling lots of drums as per my move to a new place. That drum hasn't been listed for sale - I'm keeping it and the mismatched legs. So, you got EXACTLY what was offered for sale. Apologies again for the odd pic.
I spent over $80 on shipping ("free shipping"). I'm not some pro seller, just cleraring out some extra stuff. You got a good deal or a GREAT DRUM!
So what do you folks think? Should the legs have been included? Was this deceptive?
Here is what I wrote back to him:
That picture was extremely deceptive and whether or not your are a "pro" seller really shouldn't be an issue when it comes to deceptive advertising. Yes a good deal, but you were the seller and asked what you wanted, not me. You determined shipping was free, not me. How was any prospective buyer to know that 1. the drum with the legs is not the drum you sold, and 2. that the legs are not included when you show a picture of them. The drum I purchased is not such a good deal when a set of vintage legs runs over $100 if they can be found. Shame on you.
and here is his latest response:
for all I know you're gonna pull the drum apart for parts and double your money - you sound like a real excuse for a need to get your parties in a twist about any thing. Send it back, Pal - if it's so terrible a deal!"
Am I being crazy and unreasonable? Truth please.
