Just checked and a set of three legs is up for $99 plus $13 shipping on reverb, so that may be the way to go. Ask for a $115 refund or there abouts.

This is clearly misleading. He should have shown the drum without legs, or clearly stated that the legs weren't included. And I wouldn't settle for the actual legs, because he said they are in terrible condition and that wasn't what was pictured in the ad. Let eBay give him the opportunity to make it right with a deduction of $100.

Open a case with Ebay for item not as listed. Show them the auction picture and your pictures of the same head and his emails where he lies about they legs sitting on a different drum. Ask for a refund for the legs. When it is all said and done, leave negative feedback.

The buyer can still leave feedback after a case has been opened (and decided upon) however the link to leave feedback is harder to find. As others have said open an "item not as described" case and request a partial refund if the seller refuses to send the legs.

I have never sold on eBay but have sold many things on either Craigslist or Facebook Marketplace. I don't care if it's a drum set or a set of roller skates. I only put in any picture what is being sold. You only ask for problems when you put pictures in ads that contain more than what is being sold. Even when you clearly describe it in the auction or sales ad, people still don't read half the time and expect what is pictured. If I were him I would send along those legs and chalk it up to learning for the future.

The way I look at it, I have nothing to lose, since I don't have the legs anyway, and everything to gain if eBay decides a partial refund is in order. he is still claiming the drum in the "legs" photo is a different drum. Wow, just wow.

Luckily the pictures from the eBay ad are high resolution and it is easy to zoom in on the legs and see that they are in good shape, no rust, replacement rubber tips, and clearly Gretsch RB-era legs. this guy has lied so many times and all of his lies can be clearly and easily demonstrated by his own photos. I wouldn't trust him to send the real legs even if he agreed to do so, which he won't, so a partial refund is going to be the winning situation for me.

Those legs are clearly sitting on the same drum. You can also see the Gretsch diamond mount leg mounts, the two muffler knobs, enough of the wrap to see that it is the same color and the head is not attached and the tension rods are in between the lugs. This guy is full of crap.
