Since you started this thread for all to see and give opinions, here is mine....

You're wrong! I've sold many drums and cymbals and not once did I ever ship the WRONG item and if I did make such an idiotic mistake, I would NEVER ask for it to be returned, especially after recieving the funds. You need to grow up, put your big boy pants on and take it on the chin, unbelievable.

The bottom line is this: when an offer is made and accepted, it creates a contract, and there was a contract here whether you like it or not. The seller then completed his acceptance of the contract by cashing the check - he received consideration. There must be an offer and an acceptance for a contract and there was. Whether you like it or not, whether you think the buyer is a a nice guy or not, there is not any reason for John to return said merchandise once an offer is accepted, paid for, and goods in receipt. Period. Yes, it's unfortunate that the seller sold something he didn't want to. BUT HE DID. The act of cashing the check ended the transaction because at that point the buyer owned the merchandise and was simply awaiting shipment of his new property. It would have been simpler for the seller to have said, prior to shipping, "I will return your money in lieu of shipping your cymbals"; that would have been one remedy, and John would have been the aggrieved party - but he'd have his money back, we assume. But the seller didn't do that - he shipped the cymbals and then apparently asked for a reset of the transaction because he decided it wasn't in his best interests - and that is immaterial. Whether anyone likes it or not, John has no obligation to do anything at this point, period.

I'm with John on this: I do a lot of transactions, in fact, I'm in a transactional business, and you never agree to anything that you aren't willing to carry through on no matter what it may cost you or what you find out after the handshake. Sometimes people just need to be reminded of the fact that, in the real world, this is how things work, regardless of how you may feel after you have an agreement.

This has turned into a very ugly and slanderous conversation all over some cymbals. Guys there is no need for this to continue. It is a transaction and it is final. It really does not matter who "feels" like it is the right thing to return these, there is no reason for John to do so. Had I made that mistake I would have kept it to myself. Take responsibility for your actions and let's move on to something that is not so demoralizing. Perhaps we can start arguing about what that "ring" was around the perimeter of Bonzo's reso head. That is a lot more fun.

In my opinion this is the kind of conversation that should never have been aired in public.

Contrary to what was intended... no harm done. I've dealt with this kind of thing before. After witnessing and observing Tim's behavior over the last couple of weeks, I'm not at all surprised he'd stoop to character assassination only because he cannot get his way. The other genius that fed Tim the personal information is just a coward who lacks the cohones to try to post it himself. He knows how low it is to try to -intentionally- slander someone's character, or reputation out of pure malice. So the coward put Tim up to it! And Tim used it! He posted my name (it's a big no-no, nobody ever violates anybody's privacy that way in the forums, it could be dangerous, identity theft etc.) and he posted personal information that he hopes will hurt me somehow. All because baby can't get his way! No scruples, no ethics, no holds barred. A monkey flinging crap. I hope Tim goes back and chews out the guy who used him to do something he's threatened to do himself, but never had the balls.

Malicious infants, cowards. Emotional cripples in my book! People that never grew up.

Guys!...

... well, it's been a while since we had one of "these" threads... but as I have said so many times, when one is involved in a free/public forum, well... sometimes it can get out of control. All I can really do is try to relieve the pressure here and hopefully desensitize the situation. The thread will remain for a bit, but it will be CLOSED. The hope is that the situation will be handled PRIVATELY from here out, as nothing is going to be served by airing it here PUBLICLY excepting page after page after page of vitriol. We have a fine membership here at the VDF! On occasion, there's a speed bump. THANKS as always for your understanding!
