I've got a question about a purchase that I have made gone wrong.

I'm going to have to be somewhat general so, please don't ask questions ,such as ,what kind of cymbals were they etc.

I was approached via email with an offer to buy a complete vintage kit. I knew the seller, through former purchases and had had a first rate opinion of him. The kit was offered as an advance sale ,prior to listing on ebay. I received pictures, showing a complete 5 piece kit ,set up with all original hardware, footpedal,hi-hat stand,cymbal arm,cymbal stand,an unoriginal vintage cymbal stand,unoriginal throne and 5 cymbals. I passed on the offer, mainly because it was more than I had ever spent on a kit and it went on ebay with no sale.

The seller contacted me with another 3 piece kit, also very vintage and original but basically a shell pack. I originally passed on this too but then emailed an offer to the seller for both kits, which was about 86% of his original asking price. I had previously verified, that there were some defects on the kits, something that I was familiar with and normal for this brand.

A deal was struck, shipping acertained , the bill was paid and the drums were shipped.

Upon receipt of the very large boxes, there were a few hardware items missing-----tom arm, spur,clutch,cymbal arm but most notably; there were no cymbals, no unoriginal stand and no unoriginal throne. The seller says, they weren't part of the deal but at no time was there any discussion about it. I was presented with the pictures,we discussed the deal and it was done. Not once was I told that the missing items were not included. It seems to me that sellers(and I have no previous evidence to think that this guy is not above board) should be expected to sell what they picture unless otherwise indicated. What do you all think?

I very much think this should be the way it goes!!

If it's pictured but not included, mention it before making a deal...

it may sound stupid but the easiest way to avoid discussion imho is to state the deal very clearly. something like:

"i am buying/selling ...+...+...+...(giving a detailed list of the items) for a TOTAL ammount of $..., deal?"

so far my opinion :p

Unless otherwise specified, the items in the photo are included. I always go out of my way to specify if cymbals or stands shown in demo photos are part of the deal or not.

Not to lie, I have been semi-guilty of said crime, but the buyer did not, and we are talking about a trade in my instance, discuss the transfer of hardware. So, it could be construed that I did not do my part, but then again, the buyer did not do his due diligence in requesting a full disclosure before the deal was done. So, am I at fault....not really, but then again, is the buyer an a$$ for not dissecting the deal to make sure it was all inclusive....I make those assertions now, but knew not my reputation was on the line. These small things can kill your reputation, and I have no intention of doing that to myself. I may be slow to ship sometimes, but I always get it to you in prime condition, as dealt. If I EVER short someone, let's talk about it, before getting ugly. I always try to trade in a fair manner, but never slam someone for a shortage we did not discuss in full disclosure.

That said, anyone want a train whistle...? I need a new res side snare head...

The way i do deals on this fourm and other's iam on and Ebay .Is when i send a photo what's in the photo is the deal iam offering..But say its a snare drum on a stand if the stand is not part of the deal that's stated in the email with the photo..Same goes with cymbal's and set's.I always let the buyer know what is part of the deal and what is NOT.....Mikey

Sorry that happened Calfskin.

It is so important to nail down the specifics of a deal, either way.

If you're selling, have a recent pic of ONLY what you're selling, no stands, cymbals, etc. well, unless you're selling stands or cymbals ;)

If you're buying, make sure you know what you're getting, as said above, list the item(s) to be sure.

There's always a "leap of faith" factor of dealing online, but if you're clear, it makes it easier.
