I found a Sonor teardrop kit in a gold sparkle finish on Austin cl. It had a 13, 16, 20, with a matching snare. He was asking $1,000, but agreed to $750. I met him halfway between San Antonio and Austin. The toms and kick were in the back seat, I asked where the snare was, he says it's in the front seat, but now he doesn't want to include the snare on our agreed price. He says he'll do the other drums for $600. I reluctantly said ok. It's gets better, I look at the floor and notice two holes on top of the drum, I initially thought a muffler had been removed, no big deal. As I turned the drum, there were two more holes and with another turn, two more holes. I could see indents from leg mounts. Apparently someone had moved all leg mounts to the top and then moved them back to the original place. So, there were six extra holes, plus the bottom hoop on the floor was not original. I told him I couldn't pay him $600 for the three drums, but I'd still give him our agreed price of $750 with the snare, because it was a nice drum. He said not if I was going to try to barter him down. Barter him down? We had agreed on $750 and he didn't disclose the extra holes before meeting! What an A-Hole!DOH:mad:

I've walked away on tripe like this once before, I had driven 1 1/2 hours one way. But it was worth it.
I'd never met him, I just saw his ad on cl. There was no mention of the extra holes and you couldn't see them in the picture. What makes me mad is that he had agreed on $750 for the kit with the snare. We had been texting prior to our meeting and never said a word about leaving out the snare. Then to have the nerve to say I was bartering him down because of the extra holes. He acted like he had never seen them, probably hoping I wouldn't notice. But, even after all that I was still willing to give him what we had agreed on.
Last fall I went to pick up an MIT set. About 45 minute drive. The pictures on C/L include all the stands. I get there-no stands. He tells me "I threw them out"...
Save the text messages and call police.

There was a written contract in place that both parties had agreed to.
The seller is in breach. All you can do as the buyer is walk away, or push the issue. Verbal conversations can be misinterpreted, but you have written (text) agreements to the terms and conditions.
Since the drum has six extra holes which was not disclosed, that is also grounds for the buyer to walk away with no responsibility. That is if the seller insisted the buyer honor the original agreement.
That's all I'm saying. Word of mouth you have nothing- but, here we have a written agreement, so that's a lot more solid.
