With given description legal unless Gretsch takes action. Very poor form however to create such an item without factory blessing.

I recall back 10-15 years ago when Gretsch had someone that would flag items that were listed on Ebay as Gretsch but didn't suit Gretsch. Remember that? It was a big deal. Ebay items were dropping off like flies.
Don't recall that but as another spend money sideline restore soda machines. Coke, Harley D... all have folks watching for infringement. Only way to protect the brand. If not enforced goes into a grey area. Do not want to upset that snake pit.

I don't believe there's anything illegal about making reproduction badges, logos, or brand-name facsimiles for restoration purposes. We put reproduction logos on our bass drums all the time, and reproduction Rogers script badges are readily available, as are Ludwig keystone badges. Restorers replicate logos and name badges all the time for cars, vending machines, pinball machines, clocks, vintage wagons and sleds, etc. It's part of the restoration process. Examples...

We all know it's illegal to manufacture counterfeit products and attempt to pass them off as originals (Rolex watches, Gucci handbags), but this seller is forthright and openly disclosing that his badge is a reproduction.
Illegal? I'd like to get the opinion of a copyright lawyer.

He's copying the badge design and selling it. Whether he does or doesn't pass it off as a Gretsch Badge is not the complete issue here I think. The issue I see is that he's copying the design and selling the copy. I think....and this is just an opinion....that no matter what he says in his add...it's still a copy and he's trying to profit on the Gretsch Round Badge design.
It is illegal and Gretsch can shut it down . I am an avid collector of early BMX bikes and there were people making repop decals and pad sets . Well the companies who own these names can and did shut these people down . In order for someone to make and sell repop items they have to have permission from the company who owns them or the rights to the name . Pacific who owns GT has been very aggressive about this in the last few years and very successful .
