Hi All, So hear we go again,this bidder won the auction for a gretsch "miro" snare strainer,he gets the part tells me the inside nut that holds the arm is missing, The nut that goes onto the hook part inside the strainer[iam not sure the strainer has one]So i tell him my auction was for an as-is part and the strainer work fine.but i did offer him a refund to send me the part back and if it was the one i sent to him[i will know] he would get his money refunded.So he emails me with photos of my strainer and one he has to show me the nut was missing..So i emailed back told him agian send the part back for refund...Then the other day[monday] he emails me back saying that hes going to ebay and will leave NEG feedback back if i don't email him by sunday..So what would you guys do?? Would you let it go and take the NEG feedback or offer to refund his money again??..What ia'm getting from this is he wants hes money back and keep the strainer.By the way his winning bid was only 51.00.. Another Ebay Problem With Winning Bidder
As annoying as it is, since you have a contract with him (a completed auction) you can pull his phone number from ebay. You might try talking to him, sometimes this works better than only email.
If he can prove that the nut is missing if you can find one, send it if he promises to leave good feedback. You can also agree to refund him a few bucks if he agrees to leave you positive feedback (make sure he leaves you the feedback first as part of the deal).
Beyond that, the issue of money back and negative feedback are separate.
On the feedback side, if he is going to leave you negative feedback anyway, you might as well keep the money and ignore him.
On the money side, I would only offer a refund if he agrees to leave no feedback and cancel the transaction (I would expect that if a transaction is cancelled a buyer can't leave feedback--but you should look into this).
Only when (i) you have confirmed he's sent back to you what you sent him and (ii) the transaction is cancelled, do you paypal refund him. Make sure he knows this up front.
If you ignore him now on the assumption you'll get negative feedback anyway, he would have to open a dispute and win that with paypal (assuming that's how he paid you).
The result would be that paypal would direct him to send the part back to you (at his cost) and, upon receipt, you would pay him back the auction price plus original shipping (so you are out of pocket on the shipping).
If he does open a dispute send what he says to me and I'll write up a response if I can blow a hole in his statement (I'm a lawyer).
I would appreciate it if you could tell me whether you can sell me those Gretsch RB tension rods with washers though (see buy /sell) as there are some on ebay ending soon that I will buy otherwise but with no washers--hence I prefer yours with washers and a fellow VDF member.

If he is in fact in receipt of all of your attempts to make it right, then you send all traffic to eBay and let them deal with the guy. Take a proactive approach and head the guy off. That will force his hand and make him think. It will also alert eBay to potentially unearned neg feedback which should make it easier to remove if the guy still decides to be a jerk.

In 2008 I did a lot of bankruptcy related workouts. In the end I was able to save my client £750K British pounds by taking the sorts of commercial approaches I discussed in my post above.
I agree that this guy is in the wrong, but to me it is unnecessarily haphazard to hope that eBay will do the right thing when it comes to making subjective judgments ("This very techical drum part is missing a nut", "No it isn't", "I sent him this", "he said that", "the negative feedback was unearned", etc.-- they won't jump into this arena).
Ebay was the one who set it up so only buyers can leave negative feedback and they are not willingly going to remove feedback short of a court order I would venture for if it got out then everyone would be clamoring to have their negs removed, sob stories, etc.
Thats's jus my sense: I could be wrong here and if so, please send examples of cases where ebay removed negative feedback against the will of the buyer who left it without a court order.
I would recommend Mikey trying to resolve this by himself if at all possible.
I tend to side with mcjnic on this one. I would NEVER pay for positive feedback. Based on my 30 years as a Contract Specialist I believe that doing so would give the appearance that you've done something outside the terms and conditions of the transaction. From what you've stated, your offered resolutions to this particular issue are totally ethical. Unfortunately, there are some buyers that are simply NEVER satisfied.
I've personally completed close to 490 transactions on e-Bay with 1 negative feedback. It was from p00der2. She filed a totally unwarranted and unsupported claim against me through PayPal. When the claim was denied in its entirety, she left the negative feedback.Lame Class lady over there!
Fortunately, eBay allows you to post a "remark" to the feedback, although its very limited in the amount of characters you can use. I've since excluded p00der2 from bidding on any of my items and moved on. Most individuals on eBay realize which parties to stay away from and, for the most part, do so successfully. I was initially upset that my perfect feedback rating was unjustifiably ruined, but life goes on. There are bigger fish to fry. Good luck with your transaction!
